Session Agreement

  1. Please note that no date is reserved until deposit (exactly half of the session fee) is received. Deposit is non-refundable if the client cancels or changes the engagement. Client will have 24 hours to reschedule session appointment or deposit will be lost and Client will need to book a new appointment. If the photographer fails to appear at the time and place agreed upon, the deposit shall be refunded to the Client. The remainder of your session fee is due prior to the specified date of your Session. Client may decide to pay the deposit amount or full session amount at time of booking.

  2. If Client is late for scheduled appointment, this will result in loss of time and Photographer will use the remainder of the appointment to produce the best possible images. If Client is late enough to miss scheduled appointment, deposit/payment will be lost and Client will need to schedule a new appointment. If Client exceeds time agreed for session; Client is subject to additional charges.  

  3. The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Due to the limited and subjective nature of the event, the Photographer cannot be held responsible for requested photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the event, or by the location restrictions.

  4. The Client shall assist and cooperate with the Photographer in obtaining the desired photographs, including but not limited to specifying persons and/or scenes to be photographed; taking time to pose for photographs at the Photographer’s direction; providing a person to guide the Photographer to desired persons and/or scenes; pre-shoot consultations, etc. the Photographer shall not be responsible for photographs not taken as a result of the Client’s failure to provide reasonable assistance or cooperation.

  5. Images are edited at the Photographer’s discretion, and delivered copies may not include all images shot. The Photographer reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within the Photographer’s artistic standards. Final photographs shall be delivered as digital copies only, either through email, iCloud Photo Sharing (for iPhone users only) or on a USB flash drive for an additional cost. Note that if the Client chooses to have images emailed to the email address provided, said images will be of lower quality and may require more than one email. Client may choose to separately purchase printed copies of photos taken; however, Photographer is not responsible for any photo quality loss. The client is obtaining copies for personal usage only, and shall not sell said copies. If Client is obtaining a print for newspaper announcement, editorial use, website, or social media, Photographer authorizes Client to run a credit for the Photographer adjacent to the photograph or in the photograph’s caption.

  6. If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.

  7. The Photographer is not responsible for lost photo opportunities due to other cameras or flashes, the lateness of the Client(s) or other principles. The Photographer is not responsible for the lack of coverage due to weather conditions, scheduling complications due to lateness of individuals, rules and restrictions of venue, or the rendering of decorations of the location. Clients are responsible for all location fees and permits.

  8. The Photographer will do her best to fulfill all requests but can make no guarantees all images will be delivered. The Photographer recommends that the Client point out important individuals for informal or candid photographs to the photographer during portrait shooting that they wish to have photographed. The Photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for photographs. The Photographer is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to the Photographer.
